THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38480 of 2016 ORDER:

This writ petition is filed seeking to call for records in Crime No.391 of 2016 and to quash the same.

Heard and perused the material available on record. The main grievance of the petitioners is that the 2nd respondent lodged the present complaint against the petitioners alleging that the petitioners colluded with each other and cheated the 2nd respondent's company by creating fake airway bills, invoices of consignments, which are not booked and claimed excess total amount of Rs.16,65,00,000/- and cause heavy loss to the 2nd respondent company. Learned counsel for the petitioners submitted that the 2nd respondent came to know about the alleged facts in the year 2015, but the complaint is lodged in the month of September, 2016. Considering the grievance of the petitioners and the submissions of the learned counsel for the petitioners, the 3rd respondent is directed to complete the investigation in Crime No.391 of 2016 with the help of the records available in the 2nd respondent company, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 9th November, 2016 KL
