Heard Mr.A.Jagan for petitioner and the learned Government Pleader for respondents 1 to 4.
The petitioner challenges show cause notice No.5347/ 2016A2 (P) dated 27.12.2016 issued under Section 249 (1) Panchayt Raj Act, 1994.
This Court, on 19.01.2017 granted stay of all further proceedings pursuant to the show cause notice dated 27.12.2016. The respondents filed petition to vacate the interim order. The counter affidavit of respondents refers to various circumstances under which the show cause notice has been issued. The challenge in the instant writ petition is to a show cause notice issued under Section 249 of the Panchayat Raj Act. Mr.A.
Jagan though made several submissions on the allegations in the show cause notice, the surrounding circumstances under which notice is issued and complained against non-furnishing of copies basing on which the show cause notice is issued, learned counsel realising the scope of judicial review at this stage, confines his prayer for appropriate directions to respondents 2 and 3 to furnish the copies of documents/ reports basing on which the show cause notice is issued so that the petitioner can submit detailed and purposeful reply. The Government Pleader submits that respondents 2 and 3 will furnish the copies of documents/ reports on which the show cause notice is issued, within four weeks from today.
is given two weeks time to file explanation/ objections from the date of receipt of these documents from respondents. It is needless to observe that the stage of enquiry is to receive the explanation from petitioner, no coercive steps are taken in the interregnum against the petitioner and the respondents are given liberty to pass final order in accordance with law.
The writ petition is disposed of accordingly. No order as to costs.
