G.Suresh v. State Of Telangana
THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY Crl.P.No.6530 of 2018
ORDER
This petition is filed under Section 482 Cr.P.C., to quash the proceedings in Cr.No.495 of 2018 of KPHB Colony Police Station, Cyberabad District, registered for the offences punishable under Sections 498-A and 494 IPC, against the petitioners/accused. 2.
The main contention raised by the petitioners before this Court is that in the complaint itself it is mentioned that the second respondent and A1 have mutually got divorced and that the second respondent is also married one Ch. Mohan Babu on 07.05.1997 and therefore, the question of attracting the offence under Section 498-A IPC does not arise.
3.
As per the judgment of the Apex Court in Rajesh Sharma & Others Vs. State of U.P. & another, this is a fit case to refer the matter to the Committee for report to consider any reconciliation. 4.
Having regard to the above and as per the directions of the Apex Court, this Criminal Petition is disposed of, while directing the Investigation Officer to investigate, but not to arrest the petitioners/ accused unless report of the Committee on its constitution is received, however, this order does not prevent him from securing for interrogation as part of investigation.
