THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.29964 of 2015 ORDER:

Heard learned counsel for the petitioners and the learned Government Pleader for Revenue (Andhra Pradesh) appearing for respondent Nos.1 to 4.

2. Grievance of the petitioners is that respondent Nos.3 and 4 assigned lands to them and they are cultivating the same, but without issuing any notice and without cancelling the same, the very same lands are assigned to respondent Nos.5 to 8 herein.

3. Neither the prayer for cancellation of assignment of lands made in favour of respondent Nos.5 to 8 is made before this Court nor the petitioners questioned about the grant of assignment to respondent Nos.5 to 8 by approaching the appropriate authority. Even the proceedings under which the petitioners' pattas are allegedly cancelled are not within the knowledge of the petitioners nor the said proceedings are produced before this Court. Similarly, the pattas allegedly granted to respondent Nos.5 to 8 are neither produced before this Court nor any particulars thereof are available on the record. In such a situation, it is for the petitioners to seek appropriate proceedings before the appropriate Forum, as a rowing and fishing enquiry cannot be undertaken in this writ petition.

4. Accordingly, the Writ Petition is dismissed giving liberty to the petitioners to seek appropriate proceedings before the appropriate Forum. There shall be no order as to costs.
