HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.10888 of 2015 ORDER:
Heard the learned counsel appearing for the petitioner and the Government Pleader for the Civil Supplies for the State of Andhra Pradesh.
2. This writ petition is filed seeking writ of Mandamus declaring the action of the 3rd respondent in issuing proceedings dated 03.04.2015 suspending the authorisation of the petitioner as fair price shop dealer of Kaikaram Village, Ungutur Mandal, West Godavari District, as illegal and arbitrary.
3. The authorisation of the petitioner was suspended by the Revenue Divisional Officer-3rd respondent by order dated 03.04.2015 on the ground that the petitioner has not properly distributed the items of 'Chandranna Sankranthi Kanuka' and also collected Rs.10/- per each kit from the cardholders. Before passing the impugned order, a show cause notice was issued to the petitioner and the petitioner submitted his explanation. The 3rd respondent-Revenue Divisional Officer not being satisfied with the explanation offered by the petitioner, suspended his authorisation. Since the impugned order is passed pending enquiry, this Court is not inclined to examine the merits of the said order.
4. Under these circumstances, the 3rd respondent-Revenue Divisional Officer, Eluru, West Godavari District is directed to conduct enquiry against the petitioner and pass final orders within a period of eight (8) weeks from the date of receipt of a copy of this order.
5. The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs. __________________
