HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION M.P. No.2437 OF 2017 IN/AND CRIMINAL PETITION No.2468 OF 2017 COMMON ORDR:

The present Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973 (for short 'the Code'), is filed by the petitioner - accused seeking to quash the First Information Report in Crime No.215 of 2016 of Mominpet Police Station, Vikarabaad District, for the offence punishable under Section 3 (1) (r) (s) of the Scheduled Castes and the Schedule Tribes (Prevention of Atrocities) Amendment Act, 2015.

2. Criminal Petition M.P. No.2437 of 2017 is filed by de facto complainant, who is respondent No.2 in the main petition, seeking permission of the Court to compound the aforesaid offence.

3. Both parties as well as their learned counsel are present and the parties are identified by their respective learned counsel, Sri Ch. Ganesh and Dilip Singh Thakur. The parties have also produced photostat copies of their respective "Aadhaar Cards" in proof of their identity.

4. On being enquired, the de facto complainant represents that though, he is working as waterman in Gram Panchayat office and gets only Rs.2,600/- per month towards income on the said job and that he expressed no grievance against the petitioner.

5. Since both the parties have entered into compromise and affirmed the contents of affidavit filed by the de facto complainant, compromise is recorded as the dispute falls within the guidelines laid down by the Hon'ble Supreme Court in Gian Singh v. State of Punjab1.

6. In view of the above circumstances, Criminal Petition M.P. No.2437 of 2017 is allowed and, consequently, the present Criminal Petition is allowed quashing the proceedings against the petitioner - Accused in Crime No.215 of 2016 of Mominpet Police Station, Vikarabad District. The affidavit filed by the de facto complainant shall form part of the record.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
