THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6932 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/Accused No2 seeking pre-arrest bail in the event of his arrest in connection with Cr.No.129 of 2022 on the file of Amangal Police Station, R.R.District, registered for the offences punishable under Sections 341, 326, 323, 504 r/w Section 34 IPC. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

Petitioner is A.2 in the said crime and it is alleged that on 10.06.2022 the petitioner and three others have stopped the de-facto complainant and A.1 beat him with a stone for which reason his left ear started bleeding. The allegation against this petitioner is that he beat the de-facto complainant with a stick on his back. As seen from the remand report, the de-facto complainant sustained injuries on the ear which apparently is the result of A.1 beating with a stone. There are no grievous injuries which are sustained by the act of this petitioner. Therefore, the petitioner can be granted the relief of anticipatory bail. subject to the following conditions:

1) The petitioner/Accused No.2 is directed to surrender before the Station House Officer, Amangal Police Station, R.R.District, within ten days from today and on such surrender, the said Station House Officer, shall release the

petitioner/Accused on bail, on his executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties in a like sum each to his satisfaction.

2) On such release, the petitioner/Accused No.2 shall appear before the police on every Monday for a period of eight weeks from the date of surrender for the purpose of investigation.

3) The petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
