THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8755 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.96 of 2023 on the file of Bellampalli I Town Police Station, Mancherial, registered for the offences under Sections 386, 307, 354-D, 354-C and 506 of IPC. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The allegation against the petitioner is that he came into contact with the de-facto complainant in September, 2020. Thereafter, both of them fell in love and promise was made to marry her. It is also stated that they went to OYO Hotel room at Madhapur. While they were together, photographs and videos were taken by this petitioner/ accused. Thereafter, in November, 2022, the de-facto complainant knew about petitioner's earlier marriage. The

allegation against him is that he has killed his wife. The de-facto complainant neglected the petitioner, however, the petitioner started harassing her, for which reason Rs.1 lakh was given by the brother of the de-facto complainant. It is alleged that all the photographs were deleted by the petitioner which are related to the de-facto complainant.

Learned counsel for the petitioner would submit that petitioner is in jail since 03.08.2023 and most part of the investigation is complete.

On the other hand, learned Additional Public Prosecutor on instructions, would submit that the petitioner was involved in 6 other cases, for which reason, bail has to be dismissed.

Keeping in view that most part of the investigation is complete, the prayer for regular bail can be considered, subject to following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum

each to the satisfaction of Judicial First Class Magistrate, Bellampalli. ii) The petitioner/Accused after release shall appear before the concerned Station House Officer at 10:00 a.m. everyday for a period of four weeks for the purpose of investigation and thereafter, as and when required.

iii) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
