SMT JUSTICE T. RAJANI I.A.Nos.1 and 3 of 2018 IN/AND CRIMINAL PETITION No.6028 of 2011 COMMON ORDER:

This Criminal Petition is filed, by the petitioners, who are the accused, seeking for quash of the proceedings in C.C.No.429 of 2011 on the file of Additional Judicial Magistrate of First Class, Vizianagaram. The offences alleged are under Sections 498-A read with Section 34 IPC and Sections 3, 4 and 6 of the Dowry Prohibition Act.

I.A.Nos.1 and 3 are filed by both parties seeking leave of this Court to compound the offence and to record compromise as the matter was settled out of the Court due to intervention of the elders and to quash the proceedings in the aforesaid case. 3.

The counsel for the petitioners reports that the matter ended in compromise. A Joint Memo and also the Memorandum of compromise are filed along with I.As.

The complainant and the G.P.A holder of the petitioners are present before this court and the court verified with the parties.

The complainant admitted that the matter is compromised and she does not have any objection to quash the proceedings against the petitioners.

Hence, this court opines that continuation of further proceedings against the petitioners would be an abuse of process of law.

Recording the said Joint Memo and the Memorandum of Compromise, I.A.Nos.1 and 3 are ordered. Consequently, the Criminal Petition is allowed and the proceedings against the petitioners in C.C.No.429 of 2011 on the file of Additional Judicial Magistrate of First Class, Vizianagaram, are hereby quashed. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
