HON'BLE SRI JUSTICE N.BALAYOGI CIVIL REVISION PETITION No.2883 of 2015 ORDER:

Since the suit is of the year 2012, learned counsel for the petitioner requested to dispose of the main revision with a direction to the Trial Court to dispose of the suit expeditiously. The petitioner herein, who is the plaintiff in the suit in O.S.No.97 of 2012, filed the suit for recovery of money based on promissory note.

He filed I.A.No.420 of seeking attachment of the schedule property before judgment. The Trial Court, by order dated 18.10.2012 dismissed the same. Aggrieved thereby, the petitioner filed CMA.No.1 of 2014 which was dismissed on 27.10.2013.

It is reported by the learned counsel for the petitioner that the suit, of the year 2012, is pending before the Trial Court. Since it is the money suit, I find genuineness in the submission of the petitioner.

The Trial Court is directed to dispose of the suit in O.S.No.97 of 2012 as expeditiously as possible preferably within nine months from the date of receipt of a copy of the order.

The Civil Revision Petition is accordingly disposed of. Miscellaneous petitions, if any, pending, shall stand closed. _________________ N.BALAYOGI,J Dt:23.10.2018 usd
