HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43656 of 2016 ORDER:
This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to call for the records in FIR No.95 of 2016, dated 04.11.2016 and to quash the same. Heard and perused the material available on record. The 4th respondent lodged the present complaint against the petitioners alleging that the 1st petitioner made false promises with the daughter of the 4th respondent Gaju Manasa, 17 years, by saying that he is in love with minor girl and took away from her parental residence on the name of marriage on 02.11.2016 at about 18.00 hours and deceived her with the co-operation of the remaining accused i.e.
, A-2 to A-5 and that A-5 insulted and abused her in filthy language and committed for abetment to suicide and A-2 to A-4 have also insulted and abused her in filthy language and that due to all those reasons and because of the behaviour of the petitioners, the daughter of the 4th respondent vexed up on her life and attempted for suicide by consuming poison. The main grievance of the petitioners is that the 3rd respondent is making hectic efforts to arrest the petitioners on the basis of the false complaint of the 4th respondent and that if the petitioners are arrested and detained on the false accusations, their future and reputation in the village will be damaged. Learned counsel for the petitioners submitted that the petitioners are ready to co-operate with the investigation.
respondent is directed to complete the investigation in FIR No.95 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. The petitioners are directed to execute personal bond for a sum of Rs.5,000/- (Rupees five thousand only) each with one surety each to the satisfaction of the 3rd respondent as surety for their future appearance for the purpose of investigation. With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
