THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.33924 of 2012 ORDER:

This Writ Petition is filed by the petitioner under Article 226 of the Constitution of India seeking to declare the action of the respondents in not providing certified copies of the sanctioned layout plan of the land in Survey No.7, situated at Balapur Village, R.R. District, as also the Building permission bearing No.83/2007, dated 25.06.2007, to the petitioner, as illegal, arbitrary and in violation of principles of natural justice and consequently direct the respondent No. 2 to provide certified copies of the sanctioned Layout plan of the land in Survey No.7, situated at Balapur Village, R.R. District, as also the Building permission bearing No.83/2007, dated 25.06.2007.

Heard both sides and perused the material available on record.

The case of the petitioner is that the petitioner approached the 3rd respondent through representation, dated 13.04.2011, to provide the certificate copies of the sanctioned layout of Survey No.7, situated at Balapur Village, R.R. District, which was sanctioned by the then Gram Panchayat on 14.05.1979 and also a certified copy of permission accorded on 25.06.2007 issued by the Gram Panchayat in favour of one B. Narasimha Rao, S/o. B. Gopal Rao. The 3rd respondent through his letter, dated 10.05.2011, informed the petitioner that the relevant files were not available immediately and he will make efforts to trace out such records again and he will provide the information thereafter, but so

far, the 3rd respondent has not provided any information/documents sought for under the provisions of Right to Information Act.

When the matter is taken up, it is informed by the learned Government Pleader for Panchayat Raj and Rural Development appearing for the 3rd respondent that the layout copies of the subject land are not traceable and once they are traceable, the same will be given to the petitioner. 5.

Recording the said submission, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any pending in this writ petition shall also stand closed.
