HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.6143 of 2014 ORDER:

Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for respondent Nos.1 to 3. The prayer sought in the writ petition is as under: "... to issue an order or direction more particularly one in the nature of writ of Mandamus or any other appropriate writ directing the respondents No.1 and 2 to take necessary action basing on a complaint filed by the petitioner dated 09.02.2014 against the respondent No.4 and his men."

During the course of hearing, learned Government Pleader brought to the notice of this Court that pursuant to the complaint lodged by the petitioner on 09.02.2014, a case in Crime No.100 of was registered on 12.03.2014.

After completion of investigation, a final report was filed on 28.06.2014 referring it as "mistake of fact". If that be so, the remedy available to the petitioner is to file a protest application, if he has any objections. Therefore, this Court is of the opinion that no further cause would survive in the writ petition.

Accordingly, the writ petition is closed. No order as to costs. Miscellaneous petitions, if any, shall also stand closed. _____________________ P. KESHAVA RAO, J Date: 06.11.2019.
