THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6948 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/Accused Nos.1 and 2 seeking pre-arrest bail in the event of their arrest in connection with Cr.No.214 of 2022 on the file of Manuguru Police Station, registered for the offences punishable under Sections 294 (b), 307, 323, 448, and 506 r/w 34 IPC. 2.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The case of the prosecution is that the petitioners were in the car and took up quarrel with the de-facto complainant. During the said quarrel, one of the petitioners who was driving the car tried to hit the de-facto complainant, however, he escaped and then the accused fell into a canal. Even according to the de-facto complainant he has not received any injuries. When the petitioners tried to hit him he escaped and the petitioners fell into the side canal. 4.

For the reason of the de-facto complainant not receiving any injuries in the hands of the petitioners and the entire incident took place due to the altercation between the de-facto complainant and the petitioners, the petitioners can be granted anticipatory bail on the following conditions.

1) The petitioners/Accused are directed to surrender before the Station House Officer, Manuguru Police Station, within ten days from today and on such surrender, the said Station House Officer, shall release the petitioners/Accused on bail, on each of them executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties in a like sum each to his satisfaction.

2) On such release, the petitioners/Accused Nos.1 and 2 shall appear before the police on every Monday for a period of eight weeks from the date of surrender for the purpose of investigation.

3) The petitioner/Accused Nos.1 and 2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
