This writ petition is filed challenging the proceedings dated 09.06.2017 issued by the 2nd respondent, wherein the application of the petitioner for regularisation of the commercial building in Survey No.136 of Gachibowli (Anjaiahnagar), Ranga Reddy District, was rejected by the 2nd respondent.
Learned counsel for the petitioner submits that the rejection of the regularisation application of the petitioner is not in tune with G.O.Ms.No.152, dated 02.11.2015. He also submits that the rejection order is vague and bereft of reasons, as such the same is in violation of principles of natural justice. He further submits that as per Clause-2(2) of the G.O.Ms.No.152, the 2nd respondent is not the competent authority.
Heard Sri Sampath Prabhakar Reddy, learned Standing Counsel for the respondents.
A reading of the rejection order dated 09.06.2017 goes to show that it is vague and no reasons are recorded. In view of the same, the impugned proceedings dated 09.06.2017 issued by the 2nd respondent is set aside and the competent authority is directed to reconsider the application of the petitioner for regularisation and pass fresh order.
Accordingly, the writ petition is allowed. No order as to costs.
