It is the case of the petitioner that inspite of complying with all the requirements and inspite of clarification issued by the Irrigation Department, the 3rd respondent issued shortfall letter dated 18.04.2019 seeking to obtain the change of land use from Government through HMDA. In the short fall letter issued by 3rd respondent, the Survey number shown is 573/p where the subject property is situated, whereas in the proceedings dated 13.03.2007, the Sy.No.573 is shown as residential. There is no clarification regarding by-numbers of the said survey number. In view of the above, this writ petition is disposed of, giving liberty to petitioner to approach the 3rd respondent by making a representation, complying with the requirements as indicated in the short fall dated 18.04.2019 and upon such representation being made, the respondents shall verify the documents and pass appropriate orders on the said representation including on the issue of Sy.No.573 & by number 573/p, within a period of two weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
