THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7130 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/A2 to A4 seeking bail in the event of their arrest in connection with Crime No.973 of 2020 on the file of Jawaharnagar Police Station, Rachakonda District, registered for the offences punishable under Section 306 read with 34 of Indian Penal Code. 2.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The 1st petitioner/A2 is the brother and 2nd and 3rd petitioners/A3 and A4 are sisters of the deceased.

The case of the prosecution is that the deceased and these petitioners are siblings. The deceased sold land admeasuring 7 guntas situated at Motakondur Village. However, after sale, these petitioners were demanding their share in the sale proceeds. Vexed by the constant demands made by the petitioners for part of the sale proceeds, the deceased committed suicide.

As seen from the complaint, the petitioners were asking for their share in the property sold by their deceased elder brother. 6.

In the said circumstances, petitioners who are all aged about 60 years can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioners are granted the relief of Anticipatory bail in the event of their arrest, subject to the following conditions:

1) The petitioners/A2 to A4 are directed to surrender before the Station House Officer, Jawaharnagar Police Station, Kapra Mandal, Medchal-Malkajgiri District, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners/A2 to A4 on bail, on their executing personal bonds for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/A2 to A4 shall appear before the concerned police as and when directed, for the purpose of investigation.

3) The petitioners/A2 to A4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
