THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10735 of 2012 ORDER:

The challenge in this writ petition is to the endorsement dated 13.12.2011 of the District Revenue Officer-cum-Additional District Magistrate, Chittoor, whereby the petitioner's application for reregistration of his Arm Licence was rejected. The rejection was on the ground that the Superintendent of Police had informed the said authority that the petitioner was the accused in Crime No.21 of 2011 registered under Sections 20 & 25(1-B)(a) read with Section 30 of the Arms Act, 1959 and recommended rejection of the re-registration. As the Superintendent of Police, Chittoor, had not recommended the reregistration of the petitioner's licence, his application was rejected. Sri Suresh Kumar Reddy Kalava, learned counsel for the petitioner, placed before this Court a copy of the judgment dated 19.12.2014 passed by the learned IV Additional Judicial Magistrate of First Class, Chittoor, in C.C.No.102 of 2012 arising out of Crime No.21 of 2011 registered against the petitioner for offences under various provisions of the Arms Act, 1959.

Perusal of the aforestated judgment reflects that the petitioner was found not guilty and was duly acquitted.

Sri Suresh Kumar Reddy Kalava, learned counsel, states that the aforestated judgment has attained finality. In that view of the matter, the sole ground on which the petitioner's application for re-registration of his Arms Licence was rejected, no longer survives. The endorsement dated 13.12.2011 is therefore set aside and the matter is remitted to the District Revenue Officer-cum-Additional District Magistrate, Chittoor, the 2nd respondent herein, to reconsider the petitioner's application for re-registration of his Arms Licence in accordance with law duly taking into account his acquittal in C.C.No.102 of 2012 on the file of the learned IV Additional

Judicial Magistrate of First Class, Chittoor. Such reconsideration shall be concluded expeditiously and in any event, not later than four (4) weeks from the date of receipt of a copy of this order. The writ petition is disposed of with the above directions. Pending Miscellaneous Petitions, if any, shall stand closed in the light of this final order.
