THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38251 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the 4th respondent in registering the FIR No.199 of 2016 against the petitioners, as illegal and arbitrary.

Heard and perused the material available on record. The case of the petitioners is that there are some land disputes pending between the petitioners and the 5th respondent's husband and that while so, on 26.10.2016 at about 12.00 noon at Dachepalli Village and Mandal, the petitioners along with some persons came to her house and in the vacant place in front of her house, the petitioners tried to beat coconut, and caught hold of her hair and outraged her modesty and made her fell down and beat with hands on her head and did not reveal their names and went away. On knowing the same, the 5th respondent's husband shifted her to Government Hospital, Gurazala for treatment. The main grievance of the petitioner is that the 4th respondent is trying to arrest the petitioners.

Learned counsel for the petitioners submitted that the petitioners are always ready to co-operate with the investigation and they are also ready to appear before the 4th respondent as and when required. Considering the grievance of the petitioners and the submissions of the learned counsel for the petitioners, the 4th respondent is directed to complete the investigation in FIR No.199 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. The petitioners are directed to execute a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) each with one surety each to the satisfaction of the 4th respondent as

surety for their future appearance as and when required for the purpose of investigation.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 8th November, 2016 KL
