Learned counsel for the respondent is present. In fact, on 22.1.2018 learned counsel for the appellant tendered arguments, in part. Later, notice was directed and served on the sole respondent. Thereafter, at the request of the learned counsel for the appellant, it was even deleted from the caption 'For Dismissal' twice. There was no representation for the appellant on 19.2.2018. It appears that the appellant is not inclined to prosecute the appeal, who is unsuccessful before both Courts.

Therefore, the present Second Appeal is dismissed for nonprosecution. As a sequel thereto, miscellaneous petitions, if any, pending in the Appeal shall stand closed.
