HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.21203 OF 2018 ORDER:

Heard Sri Nazir Ahmed Khan, learned counsel for the petitioners, learned Government Pleader for Municipal Administration and Urban Development appearing for the 1st respondent, and Sri N.Ashok Kumar, learned Standing Counsel appearing for the respondent - Greater Hyderabad Municipal Corporation.

When the matter is taken up, it is submitted by learned Standing Counsel for the respondent - Corporation that the report has been called for from the concerned with regard to the structural stability of the building and only after receipt of the said report, further action would be taken but not now. It is also submitted by the learned Standing Counsel that the respondent authorities will take all the precautionary measures, if the circumstances warrant only for removal of the first floor, in the direction of protecting the ground floor.

At this stage, learned counsel for the petitioners, produced a letter bearing No.JNTUH/CEH/CIVIL/MTL/5154/C-2837/2018, dated 01.08.2018, issued by the J.N.T.U.H. College of Engineering, Hyderabad, to show that the ground floor of the building is maintained well and there are no signs of distress and deterioration and the same is found to be safe and stable in its present form and usage, but the first floor of the building requires urgent repair and rehabilitation, otherwise it may collapse endangering the stability of the entire building. Hence, recording the submission of learned Standing Counsel for the respondent - Corporation and also taking into consideration the letter dated 01.08.2018, produced by the learned counsel for the petitioners, this

Court deems it appropriate to dispose of the writ petition. However, if there AVSS,J W.P. No.21203/2018 is any report against the petitioners in respect of the ground floor of the building, they shall be duly put on notice.

Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending, shall also stand disposed of in consequence.
