THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.9277 OF 2013 ORDER:

It is submitted by the learned counsel for the petitioner so also the learned counsel for the impleaded respondents 7 to 19 that the issue in the present writ petition is squarely covered by the order of this Court in W.P.No.21463 of 2011, dated 10.09.

2012 and a copy of the same is also placed on record along with the writ petition as material paper and the operative portion of the said order reads as under: "In these circumstances, it appears to us, that steps which have been taken in respect of the road connectivity project comes within the purview of the said Act and further it also appears to us that even if the writ petitioners take up the matter in question in respect of irrigation as has been stated before us by the learned counsel before us they shall take immediate steps in the matter to pass resolutions in respect of the works so to be undertaken by the Gram Panchayat under the MGNREGS Act, 2005, and, they must, after passing of the resolution shall forward it to the concerned authorities and the District Collector shall take necessary steps in the matter for executing the resolutions so to be passed by them.

In our opinion, the resolution which will be taken up should be in accordance with Section 13 of the MGNREGS Act, 2005.

The writ petition is disposed of on the above terms."

AVSS,J W.P.No.9277 of 2013 Following the above said order and for the reasons recorded therein, this writ petition is also disposed of in terms thereof.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
