The petitioner, who is a retired employee and aged about 80 years, initially filed the present writ petition challenging the action of the respondents in not considering his application dated 31.08.1998 for regularisation of three shops consisting of 10' X 30' each situated at Srinivasa Towers, situated at 3/1, Ashoknagar, Guntur, Guntur District, as illegal and arbitrary.

This Court by order dated 28.05.2009 granted interim direction not to demolish the said property till the disposal of the application for regularisation dated 31.08.1998 pending before the 2nd respondent.

When the matter is taken up today, learned counsel for the petitioner submits that sole petitioner expired. But, however, no counter affidavit is filed till today nor anyone appeared on behalf of the respondents. This Court is not inclined to keep the writ petition of the year 2009 pending in view of the above circumstances, but taking into consideration the nature of relief sought for in the present writ petition and also the interim order granted earlier, this Writ Petition is disposed of by directing the 2nd respondent to take appropriate action depending on the result of the application for regularisation submitted on 31.08.1998 by paying an amount of Rs.13,000/-.
