HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No. 8273 of 2015 ORDER:

This Criminal Petition is filed by the petitioner/Accused, under Section 482 of the Code of Criminal Procedure, 1973, seeking quashing of proceedings in C.C.No.470 of 2013 on the file of the XXIV Special Magistrate at Erramanzil, Hyderabad. A private complaint came to be filed against the petitioner/accused for an offence punishable under Section 138 of the Negotiable Instruments Act, 1881.

Though the present Criminal Petition is filed seeking quashing of proceedings in C.C.No.470 of 2013, the learned counsel for the petitioner restricts his prayer seeking dispensation of the presence of the petitioner before the trial Court on every date of adjournment, on the ground that it is difficult for him to attend the Court on every date of adjournment.

The Public Prosecutor submits that as there is no dispute with regard to the identity of the petitioner, his presence may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case and since the identity of the petitioner is not in dispute, his presence in C.C.No.470 of 2013 on the file of the XXIV Special Magistrate at Erramanzil, Hyderabad, is hereby dispensed with except on the dates when his presence is specifically required by the Court. With the above direction, the Criminal Petition is disposed of at the admission stage.

Consequently, miscellaneous petitions, if any, pending in this Criminal Petition, shall stand dismissed.
