Since both the Criminal Petitions arise out of the same crime, they are disposed of by way of this Common Order. 2.

Criminal Petition No.14012 of 2016 is preferred by the petitioner/A.4, whereas Criminal Petition No.14013 of 2016 is preferred by the petitioner/A.2, under Sections 437 and 439 Cr.P.C., seeking enlargement on bail in connection with Crime No.110 of 2016 of Korukonda Police Station, East Godavari District, registered for the offence punishable under Section 8(C) read with Section 20(b)(ii)(C) of the NDPS Act.

The case of the prosecution is that on 04.07.2016 at about 3:00 P.M., while the Inspector of Police, Korukonda Circle, was present in his office, received credible information about transportation of Ganja. After obtaining permission from the Deputy Superintendent of Police, North Zone, Korukonda, he along with his staff and mediators proceeded to coconut, palm oil and lemon garden of one Bhanuraju Master, parked their vehicles at the outskirts, entered into the garden at 4:00 P.M., and found one car bearing No.AP 35 D 3337 and one motorcycle. They also noticed four persons in possession of four packets in their hands, to be loaded in the car dicky which was parked in the middle of the garden. On seeing the police, the above mentioned four persons tried to escape, but were apprehended. On questioning, they revealed their identity and confessed that they are

CPK,J CrlP_14012 & 14013_2016 loading Ganja in the dickey and further disclosed the role of seven more persons in the commission of offence. The material before the Court would show that the accused were found in possession of 190 Kgs of Ganja. After compliance of the mandatory requirements, the Ganja was seized and the above case came to be registered. 4.

Learned counsel for the petitioners mainly submits that the allegations in the report are all false and the petitioners were falsely implicated in this case. It is submitted that as the petitioners are in jail from 05.07.2016, seeks bail.

Learned Additional Public Prosecutor opposed the petition. 6.

As seen from the record, the petitioners approached this Court earlier by filing Criminal Petition Nos.11726 and 11746 of 2016, which were dismissed on 22.08.2016. In the absence of any changed circumstances, I am not inclined to grant bail to the petitioners. However, the petitioners are always at liberty to avail remedy, if any, available under law.
