THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6952 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/A1, A3 & A10 seeking bail in the event of their arrest in connection with Crime No.250 of 2022 on the file of Kakatiya University Police Station, Warangal District, under Section 506, 386 read with 34 of Indian Penal Code and Section 25(1) (A) of Arms Act. 2.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against these petitioners is that A10 while driving a car was stopped and the police found a 'talwar' in the car. On questioning it was revealed that the car belongs to Accused No.1. During the course of further enquiry, police found that A1 and others were involving in several real estate settlements by threatening the parties with guns and swords.

In the said circumstances, when there are pending cases against accused Nos.1 and 3 which were registered under similar circumstances, this Court is not inclined to grant Anticipatory Bail to the 1st and 2nd petitioners who are Accused Nos.1 and 3.

As the 3rd petitioner/A10 is a driver of Accused No.1, he can be granted the relief of Anticipatory bail in the event of his arrest, subject to the following conditions:

1) The 3rd petitioner/A10 is directed to surrender before the Station House Officer, Kakatiya University Police Station, Warangal, within a period of ten days from the date of this order. On such surrender, the said Station House Officer, shall release the 3rd petitioner/A10 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the 3rd petitioner/A10 shall appear before the police every day between 10.00 a.m. to 1.00 p.m. for a period of four weeks, for the purpose of investigation.

3) The 3rd petitioner/A10 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 6.

Accordingly, the Criminal Petition is allowed insofar as petitioner No.3 is concerned. However, the Criminal Petition is dismissed as far as petitioners 1 & 2 are concerned. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
