THE HON'BLE SRI JUSTICE K.C.BHANU WRIT PETITION No.14495 of 2015 ORDER:

Heard both sides.

This writ petition is filed seeking a Mandamus to declare the action of the 2nd respondent in imposing onerous condition to furnish Bank Guarantee of 80% value of the seized stocks for Rs.28,47,100/- in E.C.P.No.385 of 2014, dated 14.01.2015, while releasing the stocks; in default, directing the 4th respondent to dispose of the seized stocks by conducting public auction, as illegal and arbitrary, and consequently, direct the 2nd respondent to release the seized stocks.

An appeal under Section 6-A of the Essential Commodities Act, 1955 has been filed by the petitioner along with an application for suspension of the order seizing the stocks, whereunder the petitioner was directed to furnish bank guarantee of 80% value of the seized stocks. No such bank guarantee was furnished. As stay was not granted, the competent authority can dispose of the seized stocks by conducting public auction.

There are no grounds in the writ petition and it is accordingly dismissed. There shall be no order as to costs.

Consequently, the miscellaneous applications, if any shall also stand disposed of.
