HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7367 of 2015 ORDER :

This Criminal Petition is filed by the petitioner/ accused under Section 482 Cr.P.C to quash the proceedings in C.C. No.989 of 2014 on the file of XXIV Metropolitan Magistrate Court, Cyberabad at Kukatpally, which is a case filed by the 2nd respondent-de facto complainant for the offence under Section 138 r/w 142 of N.I Act for the cause of action occurred for dishonour of cheque.

2) Heard learned counsel for the petitioner/ accused and the 1st respondent-State represented by the Public Prosecutor before admission and before ordering notice to the 2nd respondent and perused the material on record.

3) As the facts fall short for this Court to admit the application under Section 482 Cr.P.C for quashing the calender case but for the Criminal Petition is disposed of. If there is any inconvenience to the petitioner/ accused being a lady to appear personally before the trial Court, she is at liberty to file an application under Section 205 Cr.P.C before the learned Magistrate after giving notice to 2nd respondent -de facto complainant and the learned Magistrate shall hear and permit with necessary conditions including personal appearance as and when required.

4) Miscellaneous petitions, if any pending, shall stand

closed.
