HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.6542 of 2018 ORDER :

The petitioner, who is A1 in Crime No.193 of 2018 of S.N.Puram Police Station, Vijayawada, filed the present application under Sections 437 and 439 Cr.P.C. seeking enlargement on bail in the above crime, registered for the offences punishable under Sections 489(B)(C) I.P.C. He is in judicial custody since 23.04.2018.

The learned counsel for the petitioner submits that the petitioner is innocent and falsely implicated in the above crime, when he is traveling in the train and the so called fake currency is a false story to implicate him on suspicion and his address is Mohimarri Village, Kamras District, Assam State, in the border to the neighbouring country.

The learned Public Prosecutor submits that there are other accused, who are absconding and are yet to be apprehended.

Heard and perused the F.I.R., remand report, bail application averments and Part-I Case Diary.

Among the two penal provisions, so far as Section 489B I.P.C. is concerned, it is punishable above 10 years and upto life. A perusal of the record shows that the investigation is yet to complete, two more accused yet to apprehend and F.S.L.report yet to receive, despite disclosure of the petitioner of leading to fake currency produced from the borders. Hence, the petitioner does not deserve concession of bail pending investigation. 6.

Accordingly, the Criminal Petition is dismissed. 7.

Consequently, miscellaneous petitions, if any shall stand closed.
