THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.24562 OF 2019 O R D E R :

This writ petition is filed seeking a Writ of Mandamus, declaring the action of the 3rd respondent in terminating the services of the petitioner vide proceedings dated 23.09.2019, as illegal and arbitrary and sought for a consequential direction to respondent No.3 to allow/reinstate the petitioner into service by setting aside the order dated 23.09.2019.

Heard the learned counsel for the petitioner and Smt.R.Padma Rekha, learned Standing counsel for respondent No.3.

It has been contended by the petitioner that she was placed under suspension vide proceedings dated 23.09.2019 by the 3rd respondent without there being any charge sheet or charge memo and that she had submitted a representation on 04.10.2019 requesting the respondents to revoke the suspension orders and reinstate her into service. But so far, the respondents have not passed any orders on the said representation. Learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner on 04.10.2019 and pass appropriate orders.

Learned Standing counsel appearing for the respondents had contended that since representation submitted by the petitioner is pending with the respondents, the respondents would

consider the same and pass appropriate orders in accordance with law.

This Court, having considered the rival submissions of both the parties is of the considered view that this Writ Petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 04.10.2019 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
