HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P. No.312 of 2016 ORDER:

This petition is filed to transfer O.P.No.102 of 2016 from III Additional Senior Civil Judge, Kakinada, East Godavari District, to III Additional Family Court at Malkajgiri, Ranga Reddy District.

2. Wife filed this petition. According to her affidavit, her marriage was performed with respondent on 11.12.2013 at Kapra, Ranga Reddy District, and the marriage was consummated and they are blessed with a daughter on 04.04.2015, now aged about 14 months. She stated that she is now residing at her parents house at Kapra and respondent-husband filed O.P.No.102 of at Kakinada and it is difficult for her to travel from Hyderabad to Kakinada, which is more than 500 kms. She further stated that she has to look after her 14 months baby, therefore, it is just and necessary to transfer O.P.No.102 of 2016 from Kakinada to Malkajgiri.

3. Respondent has not filed any counter.

4. Heard both sides.

5. Advocate for petitioner submitted that by taking into consideration of convenience of petitioner, O.P.No.102 of 2016 pending before III Additional Senior Civil Judge, Kakinada, may be transferred to Ranga Reddy.

6. Advocate for respondent submitted that the

objection raised in the counter with regard to jurisdiction of Kakinada Court is not tenable, however, except Malkajgiri Court, O.P.No.102 of 2016 may be transferred to any other Court in Ranga Reddy, for which respondent has no objection.

7. Considering the submissions of both sides, O.P.No.102 of 2016 is withdrawn from III Additional Senior Civil Judge, Kakinada, East Godavari District, and transferred to Family Court at L.B.Nagar, Ranga Reddy District, for disposal in accordance with law.

8. Accordingly, transfer C.M.P. is ordered.

9. Miscellaneous petitions pending, if any, shall stand closed.
