THE HONOURABLE SRI JUSTICE M.LAXMAN CIVIL REVISION PETITION No.5674 of 2010 ORDER:

The civil revision petition is filed against order dated 14.10.2008 in E.A.No.176 of 2006 in E.P.No.37 of 2004 in O.S.No.459 of 1993 on the file of I Additional District Judge, Nizamabad (hereinafter referred to as 'executing Court'), whereunder, the application filed by the respondents herein seeking to direct the appellant herein to calculate compensation amount, was allowed. Aggrieved by the same, the present revision is filed at the instance of the respondent therein.

The present revision petition is filed against the orders passed in the execution petition relating to calculation for payment of compensation under Land Acquisition Act, 1894. The grievance before the executing Court was that certain benefits granted in the Land Acquisition Act, were not entitled prior to the Land Acquisition (Amendment) Act and the same was negated by the executing Court. 3.

The revision petitioner has filed the present revision in the year 2010, in respect of 27 claimants, who obtained decrees and have been making efforts to execute the decrees, which they have obtained in the year 1993. Due to filing of the present revision

ML,J CRP_5674_2010 petition, the efforts of respondents, to execute decrees is frustrated, for the last 12 years. Further, no efforts have been made by the revision petitioner to take out service of notice on the respondents. There is great indifference on the part of the revision petitioner. Hence, I do not find any merit in this revision petition. 4.

In the result, the civil revision petition is dismissed. There shall be no order as to costs. Interim orders, if any granted earlier shall stand vacated and miscellaneous petitions, if any, pending shall stand closed.
