THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.33460 of 2017 ORDER:
Challenging the Order dated 03.10.2017 passed by the 2nd respondent-District Collector (P.R.Wing), Ranga Reddy District, in terms of Section 249 of the A.P. Panchayati Raj Act, 1994 (Telangana Adoption) (in short "the Act"), the present Writ Petition is filed.
Earlier, when the matter was listed on four occasions, it was heard for sometime at length, and thereafter, the matter was adjourned. Today, when the matter is taken up, it is brought to the notice of the Court that on 07.10.2017, the petitioners had invoked the jurisdiction of the appellate authority and filed an appeal challenging the impugned order. In view of the same, learned Senior Counsel, appearing for the petitioner, in all fairness, submits that to pursue the remedy of appeal filed before the Government, a definite date may be fixed for hearing. Sri Rajiv Reddy, learned Counsel appearing on behalf of the learned Government Pleader for Panchayat Raj (Telangana), on instructions, submit that on 24.02.2018, the hearing would be held in Advocate General's Office at 3.30 p.m.
In the circumstances, the Writ Petition is disposed of with a direction to the 1st respondent to consider the appeal filed by the petitioner, after giving an opportunity of hearing to him, either in person or through a counsel, and pass orders on merits. For any reason, if the appeal is not taken up on that day, the 1st respondent shall pass necessary interim orders in the subject matter. No order as to costs.
Consequently, Miscellaneous Petitions pending, if any, in this Writ Petition, shall stand closed.
