THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5007 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in FIR No.33 of 2016 on the file of the Obulavaripalli Police Station, Kadapa District, registered for the offence punishable under Sections 355 IPC and Section 3 (i)(r) of SCs & STs (POA) Act.

Heard and perused the material available on record. The 2nd respondent is working as clerk in the shop of the petitioner and on 28.3.2016, as per the directions of the petitioner, the 2nd respondent took liquor bottles from the shop and gave them to Eshwaraiah of Mangapeta. In his return, while he was talking with his uncle in front of Induvadana Wines, the petitioner came to him and slapped him with a slipper thrice and scolded him in filthy language in the name of his caste. Then, the 2nd respondent came to the shop and when he picked liquor bottle cases to keep them on his vehicle to go to Y. Kota, one box fell down and bottles were broken. Then, the petitioner scolded him.

The allegations made in the complaint are serious in nature and therefore, this Court is not inclined to grant the relief sought by the petitioner.
