Smt Mothe Shirisha v. Government Of Andhra Pradesh
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12712 OF 2012 DATED: 25.06.2015 Between:
Smt. Mothe Shirisha .. Petitioner And Government of Andhra Pradesh, Rep. by its Superintendent of Police, Warangal, and others.
.. Respondents THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12712 of 2012 ORDER:
This writ petition was filed assailing the action of the police authorities in not rendering help to the petitioner to maintain her possession pursuant to the order granted by the learned V Additional Junior Civil Judge, Warangal, in I.A.No.2577 of 2009 in O.S.No.1200 of 2009.
Sri Alladi Ravinder, learned counsel for the petitioner, fairly conceded that there was no direction by the trial Court to the police to afford protection to the petitioner to ensure compliance with its order. In that view of the matter, this Court is of the opinion that the police authorities cannot be found fault with for not coming forward to give protection to the petitioner in the context of the trial court's order. The writ petition is therefore dismissed leaving it open to the petitioner to avail appropriate remedies in accordance with law. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
