O R D E R
Heard Mr. Gopala Krishna, learned counsel representing Ms. Y. Malathi, learned counsel for the petitioner, Mr. P. Jagadish Chandra Prasad, learned Standing Counsel for Visakhapatnam Urban Development Authority, and Mr. S. Lakshmi Narayana Reddy, learned Standing Counsel for Greater Visakhapatnam Municipal Corporation. The prayer of the petitioner in this case is as under: "The Hon'ble Court may be pleased to issue Writ, or Order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the Respondents not regularizing the Petitioner Plot No.265, in Sy.No.270/2, situated at Sri Balajinagar layout, Desapatrunipalem Village, Parvada Mandal, Visakhapatnam District as illegal arbitrary and unconstitutional, and consequently direct the Respondent authorities to regularize the Petitioner plot and pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case."
It appears that the petitioner's representation dated 20.05.2013 whereby she sought regularization of her plot is still pending consideration before the Visakhapatnam Urban Development Authority. In that view of the matter, this Court sees no purpose in entertaining this writ petition for adjudication on merits. It is for the authority concerned to apply its mind to the petitioner's representation and take a decision thereon in the first instance.
The writ petition is accordingly disposed of directing the Visakhapatnam Urban Development Authority to consider the petitioner's representation dated 20.05.2013 and take appropriate action thereon in accordance with law. In the event the petitioner's request is rejected, the reasons therefor shall be duly recorded and communicated to her. This exercise shall be completed expeditiously and in any event not later than eight weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions shall stand closed in the light of
this final order. No order as to costs.
