HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 12619 of 2012 ORDER:

Heard learned counsel for the petitioners, Government Pleader for Revenue and learned Standing Counsel for respondent No.5. With the consent of all the parties, the writ petition is heard at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the proceedings Rc.No.1438/2011 B dated 16.10.2011 issued by the second respondent, as illegal, arbitrary, unjust, contrary to law and violative of principles of natural justice; and consequently set-aside the same and direct the respondents not to dispossess the petitioners from the house sites situated in Sy.No.69/5 to 3 in Vizianagaram bit-I, Vizianagaram Mandal and District. Though the petitioners claimed various reliefs but their main grievance is that the appeal filed before the third respondent-Joint Collector, Vizianagaram vide Rc.No.3182/2011 E.4, is still pending consideration and hence a direction may be given to dispose of the same at the earliest. Learned Government Pleader did not dispute the said fact.

Without going into the merits of the case and having regard to the circumstances stated, the writ petition is disposed of directing the third respondent, to dispose of the appeal filed before him against the order of canceling house site pattas issued by the Revenue Divisional Officer, Vizianagaram vide proceedings Rc.No.1438/2011 B dated 16.10.2001, in accordance with law, within a period of twelve (12) weeks from the date of receipt a copy of this order. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ

Petition shall stand closed.
