HON'BLE THE ACTI NG CHI EF JUSTI CE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTI CE A.SHANKAR NARAYANA W.A.M.P.No.1156 of 2016 and W.A.M.P No. 2576 of 2016 I N/ AND WRI T APPEAL No. 1207 OF 2016 Common Judgment (Per the Hon'ble the Acting Chief Justice Sri Ramesh Ranganathan) The order under appeal relates to a slaughter house being run by the Amalapuram Municipality which, by the order under appeal, was directed not to allow any slaughtering operations to be carried on therein unless permission is obtained from the A.P. Pollution Control Board as required in accordance with the strict procedure established by law, and in terms of the provisions of the Air (Prevention and Control of Pollution) Amendment Act, 1987 and Water (Prevention and Control of Pollution) Amendment Act, 1988.

The Amalapuram Municipality, which is running the slaughter house, has been arrayed as a respondent in the writ petition. The applicants herein claim to be utilising the services of the slaughter house. They are neither necessary nor proper parties to these proceedings. In any event, the direction of the learned Single Judge is only to comply with the directions of the Pollution Control Board, and the Pollution Laws applicable in this regard, before the slaughter house recommences operations. We see no reason therefore, to grant leave to appeal thereagainst.

The application seeking leave is dismissed. The application seeking condonation of delay of 63 days in filing the appeal is also dismissed.
