HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.5270 OF 2013 ORDER:

In this petition filed under Section 482 Cr.P.C, petitioner/A1 seeks to quash the proceedings in C.R.No.2037 of 2013 on the file of II Additional Judicial Magistrate of First Class, Nellore, registered for the offence under Sections 427, 447, 342, 506 r/w 34 IPC.

When the matter came up for hearing, learned Assistant Public Prosecutor produced the letter dated 28.06.2018 of Sub-Inspector of Police, Nellore II Town Police Station, Nellore District and submitted that after filing of charge sheet, STC.No.5629 of 2013 was registered and the same was ended in conviction vide judgment dated 27.06.2013 and therefore, the subject matter of the petition which is filed to quash the proceedings in C.R.No.2037 of 2013 has become infructuous and hence the same may be dismissed.

In view of the above submission of learned Public Prosecutor, the Criminal Petition is dismissed as Infructuous. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
