THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.7111 of 2019 ORDER:

This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioner/Accused seeking to quash the proceedings against him in C.C.No.104 of 2019 on the file of VIII Special Magistrate, Erramanzil.

Heard the learned counsel for the petitioner/Accused, the learned Additional Public Prosecutor representing the 1st respondent-State and perused the record.

Though learned counsel for the petitioner filed the petition for quashing the proceedings in the aforesaid Calendar Case, he restricts his prayer seeking dispensation of personal appearance of the petitioner/Accused before the Court below.

Having regard to the facts and circumstances of the case and considering the request of learned counsel for the petitioner, without expressing any opinion on the merits of the case, the personal appearance of the petitioner/Accused in C.C.No.104 of 2019 on the file of VIII Special Magistrate Court, Erramanzil, is dispensed with, while permitting him to make his appearance through counsel. However, the petitioner/Accused shall appear before the Court below as and when his personal appearance is so warranted, in respect of the aforesaid Calendar Case.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
