HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 2681 of 2012 ORDER:

Heard learned counsel for the petitioner and learned counsel for the respondents.

The present writ petition came to be filed seeking issuance of writ of certiorari calling for records pertaining to proceedings Ref. VJRO:NCK:RET, dated 11.01.2012 and 16.09.2010 passed by respondent No.1 and proceedings dated 03.01.2012 issued by respondent Nos.5 and 6 and to quash the same holding that the same are illegal, arbitrary and violative of principles of natural justice.

Pending the writ petition, the petitioner filed W.P.M.P.No.2177 of 2015 seeking a direction to the first respondent corporation to consider the case of the petitioner for awarding retail outlet dealership at Nalgonda Town, in view of the fact that respondent No.8, who is No.1 in the panel, sought for cancellation of his empanelment due to his personal and financial problems.

The Standing Counsel for the respondents Corporation placed on record a copy of letter dated 07.06.2014 written by respondent No.8 to the Senior Regional Manager, Hindusthan Petroleum Corporation Limited, Vijayawada Regional Office, Thadepalli, Guntur District.

A perusal of the letter shows that respondent No.8 has decided to drop himself from taking over the retail outlet due to

financial and personal problems and also because of his preoccupation with his job. In view of the above, learned counsel for the petitioner submits that the candidature of the petitioner may be considered since he is No.2 in the panel.

Without going into the merits of the case and having regard to the circumstances stated above, the writ petition is disposed of, advising the first respondent to consider the case of the petitioner for the retail outlet at Devarakonda Road, Nalgonda, in accordance with law. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
