HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.46382 of 2016 O R D E R :

The Writ Petition is filed under Article 226 of the Constitution of India seeking to call for records relating to charge-sheet in C.C.No.63 of 2016 on the file of the XV Chief Metropolitan Magistrate, Nampally, Hyderabad in F.I.R.No.205 of 2016, dated 21-10-2015 by the S.H.O., Women Police Station, Begumpet, Hyderabad, for the offence under Section 498-A I.P.C. and quash the same as being illegal and arbitrary. Heard and perused the material available on record. The petitioners filed this writ petition challenging the charge-sheet in C.C.No.63 of 2015. This Court is not inclined to interfere with the proceedings before the court concerned. However, considering the facts and circumstances of the case, the petitioners are directed to file discharge petition before the concerned court, if they are aggrieved by the initiation of proceedings in C.C.No.63 of 2016.

With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, Miscellaneous Petitions pending, if any, in the Writ Petition shall stand closed.
