The criminal petitions are filed by the petitioner seeking for quash of the proceedings in CC.Nos.110, 68 and 155 of 2005 on the file of the Judicial First Class Magistrate, Allagadda, Kurnool District. 2.

Heard counsel for the petitioner; counsel for respondent No.1 and the learned Public Prosecutor, who takes notice for R1 and R2. 3.

The counsel for the respondents reports that the matter has become infructuous as it is compromised.

The counsel for the petitioner submits that the Court below failed to allow the petition filed under Section 257 of the Criminal Procedure Code to dismiss the petition as withdrawn. The counsel draws the attention of this Court to the memorandum of understanding entered into between the parties agreeing to withdraw the above cases. The counsel for the respondent does not refute the said submission made by the petitioner's counsel. 5.

Hence, in view of the memorandum of understanding wherein the parties agreed for withdrawal of the cases, based on the compromise, there will not be any purpose served by continuing further proceedings in CC.Nos.110, 68 and 155 of 2005. The criminal petitions are allowed and the further proceedings in CC.Nos.110, 68 and 155 of 2005 on the file of the Judicial First Class Magistrate, Allagadda, Kurnool District, are hereby quashed.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
