THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11293 of 2015

ORDER

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner-A19 seeking bail in Cr.No.152 of 2015 of Railway Kodur Police Station, Kadapa District, registered for the offences punishable under Sections 147,148,353, 307,120(B),379 r/w.Sec.149 IPC and under Section 20(1)(c) (ii)(iii)(iv) & (vi), Sec.29(iv)(a) of A.P.Forest Act, 1667, Rules 3 and 4 of A.P.Red Sanders Wood Transit Act, 1969 and under Section 3 of Prevention of Destruction to Public Property Act, 1984.

2. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

3. It is alleged that on 08.09.2015 at about 6.00 AM., at Balapalle Check Post, Railway Kodur Mandal, on information, the police officials when tried to stop the car, the occupants of the car tried to run over the police to kill them and also hurled stones on them, but the police caught hold of 8 persons, who informed about smuggling of red sanders.

4. Learned counsel for the petitioner/A19 contended that based on the confession of co-accused only, the petitioner's name was implicated in this case.

5. The petitioner was arrested on 20.09.2015. Since the confession of co-accused is relevant for the purpose of investigation, this Court is not inclined to grant bail to the petitioner at this stage.
