In spite of granting several adjournments to 28.4.2017, 23.8.2017, 15.9.2017 and 22.9.2017, none appeared for the appellant. There is also no representation on behalf of the appellant. On the last occasion, while adjourning the matter to this day, this Court ordered "in the interest of justice, without passing any adverse remarks, post on 4.10.2017 under the same 'caption'. But none appeared today. It clearly shows that the appellant is not acting diligently to prosecute the appeal. Hence, this MACMA is dismissed for non-prosecution with costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
