THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6963 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. seeking to enlarge the petitioner/Accused No.3 on bail in the event of his arrest in connection with Cr.No.51 of 2022 on the file of Sadhashinagar Police Station, registered for the offence punishable under Section 307, 323, 506 r/w 34 IPC.

The Petitioner who is A.3 is alleged to have been present when A.1 attacked the de-facto complainant. The said altercation took place on 02.04.2022 on the reason of there being previous enmity. This Court by order dated 07.06.2022 granted bail to the A.1, who according to the prosecution was the person responsible to inflict injuries on the de-facto complainant. A.2 and A.4 were already ranted regular bail on 05.05.2022. Since there are no specific overt acts attributed to this petitioner in the complaint, this petitioner can be granted the relief of anticipatory bail on the following conditions:

1) The petitioner/Accused No.3 is directed to surrender before the Station House Officer, Sadhashinagar Police Station, within ten days from today and on such surrender, the said Station House Officer, shall release the petitioner/Accused No.3 on bail, on his executing personal bonds for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties in a like sum each to his satisfaction.

2) On such release, the petitioner/Accused No.3 shall appear before the police on every Monday for six weeks for the purpose of investigation.

3) The petitioner/Accused No.3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
