THE HON'BLE SRI JUSTI CE S.V.BHATT W RI T PETI TI ON No.3 7 3 7 1 of 2 0 1 6 ORDER:

Heard learned counsel for petitioner and learned Government Pleader for respondents.

Admittedly, the petitioner has an effective remedy of appeal against proceeding impugned in the writ petition. This Court, on the ground of availability of alternative and effective remedy of appeal, is not inclined to entertain the instant writ petition. 4.

Learned counsel for the petitioner submits that the petitioner has already filed an appeal against the proceeding impugned in the writ petition before the second respondent.

5.

Since appeal is already filed by the petitioner, the second respondent is directed to dispose of the appeal within four (4) weeks from the date of receipt of copy of this order. Petitioner is given liberty to communicate copy of this order with the appeal already filed before the second respondent for expeditious disposal of the appeal. The writ petition is disposed of. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
