HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.30335 of 2016 ORDER:

The case of the petitioners is that the agricultural land in an extent of Ac.2-88 cents in Sy.No.610/9 of Magallu Village, Nandigama Mandal, Krishna District is the ancestral property of petitioners and said land is in possession of their family from their forefather's time and their ancestors have been cultivating the same since more than 100 years. Originally the subject land was in possession of their grandfather late Kancharla Ramaiah S/o.Kondaiah. Thereafter, 1st petitioner father late Kancharla Raghava Rao inherited the same from her father and after death of her grandfather Kancharla Ramaiah, the land was mutated in revenue records in the name of her father Kancharla Raghava Rao. The name of 1st petitioner's father was entered in 1-B Register and Adangals.

The pattadar passbook and title deed was also issued in favour of late Kancharla Raghava Rao. After his death, the subject land was mutated in the name of 2nd petitioner, mother of the 1st petitioner.

land to an extent of Ac.2-88 cents in Sy.No.610/9 is a Tank and therefore, partition deed cannot be registered. The petitioners submitted a representation to the respondents 2 to 4 on 03-03-2016 to withdraw intimation given to the 5th respondent that the subject land is a tank. As no action has been taken on the same, the present writ petition is filed.

Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. Since the grievance of the petitioners in the writ petition is already pending before the 2nd respondent, the 2nd respondent is directed to consider the same and pass orders in accordance with law. The said exercise shall be done within a period of two months from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 27-09-2016 Nvl
