THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37056 of 2015 ORDER:
The grievance of the petitioners is that the police authorities are not providing protection to them for formation of fish tanks in an extent of Acs.4.00 cents in Survey No.237/2, 3, 4 & 5, an extent of Acs.6.77 cents in Survey No.238/2, 241/2A, 241/3 & 242/4 and an extent of Ac.0.93 cents in Survey No.241/2, 3, 242/3, & 4, totalling to Acs.11.65 cents in Pamulaparru Village, Undi Mandal, West Godavari District. The petitioners state that the Deputy Director of Fisheries, West Godavari District, has already issued letter dated 24.09.
2015 to the Station House Officer, Undi Police Station, Bhimavaram Rural Circle, West Godavari District, referring to the fact that the petitioners have been issued provisional licences to dig new fish tanks in the subject lands and requesting the police authorities to provide necessary protection to them while undertaking digging of the tanks. Learned Assistant Government Pleader for Home fairly conceded that in the light of this communication, the police authorities would provide protection to the petitioners as and when they intimate the date of their undertaking digging operations.
The writ petition is accordingly disposed of permitting the petitioners to intimate in writing to the Station House Officer, Undi Police Station, Bhimavaram Rural Circle, West Godavari District, the date that they wish to undertake the digging operations in relation to their new fish tanks. Upon such intimation being given, the police authorities will provide protection and take steps under Section 149 Cr.P.C. to prevent commission of any cognizable offence. Pending miscellaneous petitions, if any, shall stand closed in the light of this
final order. No order as to costs.
