HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE MRS JUSTICE ANIS Writ Petition No.31658 of 2016 Order: (per V.Ramasubramanian, J.) The petitioner who was born in Saidapuram village of YSR district in the State of Andhra Pradesh on 03-10-1997, but who had to study in various schools all over India on account of her father being employed as a Constable in the Central Industrial Security Force (CISF), has come up with the present writ petition seeking a mandamus to direct the respondents to grant her local status.

2. Heard Mr. V.Maheswar Reddy, learned counsel for the petitioner. Mr. Taddi Nageswara Rao, learned counsel, takes notice for the 1st respondent. The learned Government Pleader for Medical Health and Family Welfare (Andhra Pradesh) takes notice for the 2nd respondent.

3. The nativity of the petitioner is not in doubt. It is true that she does not satisfy the criteria of spending 4/7 years in the State. But the problem is that her father was employed in the CISF. Therefore, as we have held in the case of an Army Man's daughter, the petitioner is also entitled to similar reliefs.

4. Therefore, the writ petition is allowed directing the respondents to treat the petitioner as a local candidate, in view of her nativity in the State of Andhra Pradesh. The petitioner shall apply in terms of para 4(d) of the Circular

Memo dated 08-8-2016, after which she may be granted the benefit of a candidate with local status. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
